If you are purchasing on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms, and "you" shall refer to both you individually and that entity.

Your continued use of our website or products after any update to these Terms constitutes acceptance of the revised Terms.

MindfulKit is a digital wellness brand offering downloadable guides, resources, and AI-powered tools designed to help individuals build healthier relationships with technology and lead more intentional lives.

MindfulKit operates as MindfulKit LLP, a company registered in India. Our registered address and contact details are provided in Section 15 of these Terms.

Our products are designed for personal development and wellness purposes only. We are not a licensed medical, psychological, financial, or legal services provider.

3.1 Digital Guides & eBooks

MindfulKit sells downloadable digital products including eBooks, workbooks, guides, and toolkits ("Digital Products"). All Digital Products are delivered electronically. No physical goods are shipped.

3.2 Free Tools

We may offer free AI-powered tools on our website, such as the Clarity Guide decision assistant. These tools are provided on an "as is" basis at no charge and are subject to availability.

3.3 Eligibility

Our Services are available to individuals aged 18 years and above. By using our Services, you confirm you meet this age requirement. If you are under 18, you may only use our Services with the involvement of a parent or guardian.

3.4 Product Descriptions

We make every effort to describe our Digital Products accurately. However, we do not warrant that product descriptions or other content on our site are error-free, complete, or current. We reserve the right to correct any errors and to update information at any time.

4.1 Pricing

All prices are displayed in Indian Rupees (INR) unless otherwise stated. Prices are inclusive of applicable taxes where required by law. We reserve the right to change prices at any time without prior notice. Price changes do not affect orders that have already been completed and paid for.

4.2 Payment Methods

We accept payment via Instamojo, UPI, debit/credit cards, and other methods displayed at checkout. Payment is processed securely by our payment partners. MindfulKit does not store your card details.

4.3 Order Confirmation

Once your payment is confirmed, you will receive an email with a download link or access instructions for your Digital Product. Please check your spam/junk folder if you do not receive this email within 15 minutes.

4.4 GST & Taxes

Where applicable under Indian tax law, Goods and Services Tax (GST) may be included in the price displayed. MindfulKit complies with applicable Indian tax regulations.

5.1 Digital Products — General Policy

Because our products are digital downloads delivered immediately upon purchase, all sales are generally final. We do not offer refunds once a Digital Product has been accessed or downloaded.

5.2 Exceptions

We will consider a refund or replacement in the following circumstances:

• The file is corrupted, unreadable, or technically defective upon delivery.
• You were charged multiple times for the same order due to a payment processing error.
• The product delivered is materially different from its published description.

5.3 How to Request

To request a refund under the above exceptions, email support@mindfulkit.in within 7 days of your purchase date, with your order number, a description of the issue, and any relevant screenshots. We will respond within 3 business days.

6.1 Ownership

All content on mindfulkit.in — including but not limited to text, graphics, logos, eBook content, guides, templates, and tools — is the exclusive intellectual property of MindfulKit LLP or its content licensors, protected under Indian and international copyright law.

6.2 Licence for Personal Use

Upon purchasing a Digital Product, MindfulKit grants you a non-exclusive, non-transferable, personal licence to use the product for your own individual, non-commercial purposes. This licence does not transfer any ownership rights to you.

6.3 Restrictions

You may NOT, without our prior written consent:

• Copy, reproduce, republish, or redistribute any MindfulKit content in any form.
• Sell, resell, sublicence, or commercially exploit any Digital Product.
• Share your purchased product with others, including via file-sharing platforms or group chats.
• Modify, adapt, translate, or create derivative works based on our content.
• Remove or alter any copyright, trademark, or proprietary notices.
• Use our content for training artificial intelligence or machine learning models.

6.4 Trademarks

"MindfulKit" and the MindfulKit logo are trademarks of MindfulKit LLP. You may not use our trademarks without prior written permission.

MindfulKit may offer AI-powered tools such as the Clarity Guide personal decision assistant. The following terms apply specifically to these tools:

7.1 Nature of AI Guidance

AI-generated responses are for informational and reflective purposes only. They do not constitute professional medical, psychological, financial, legal, or therapeutic advice. You should not rely on AI-generated content as a substitute for consultation with a qualified professional.

7.2 No Professional Relationship

Use of any AI tool on mindfulkit.in does not create a professional relationship of any kind between you and MindfulKit, or between you and any AI provider.

7.3 Crisis Situations

Our AI tools are not equipped to handle mental health emergencies or crisis situations. If you or someone you know is in crisis, please immediately contact a qualified mental health professional or a crisis helpline such as:

7.4 Data & Privacy

Text you enter into AI tools on our website may be processed by third-party AI providers (including Anthropic) to generate responses. We do not store the content of your AI conversations. Please do not enter sensitive personal information such as your full name, contact details, financial information, or government identification into AI tools.

7.5 Accuracy

AI-generated content may contain inaccuracies, errors, or omissions. MindfulKit makes no warranty as to the accuracy, completeness, or fitness for purpose of any AI-generated response. Use your own judgement and seek appropriate professional advice before making significant life decisions.

7.6 Availability

AI tools are offered free of charge and are subject to availability. We may modify, suspend, or discontinue these tools at any time without notice.

When using mindfulkit.in or any of our tools, you agree not to:

• Violate any applicable law, regulation, or third-party rights.
• Use our website or AI tools to transmit harmful, abusive, defamatory, threatening, or unlawful content.
• Attempt to gain unauthorised access to our systems, databases, or networks.
• Introduce malicious code, bots, scrapers, or automated tools to our website.
• Impersonate MindfulKit, its team members, or any other person or entity.
• Use our AI tools to attempt to bypass safety filters or elicit harmful outputs.
• Circumvent any technical measures we implement to protect our Services or content.
• Engage in any conduct that could damage our reputation or business interests.

We reserve the right to terminate access to our Services for any user who violates these prohibitions, without notice and without refund.

To the maximum extent permitted by applicable law, MindfulKit provides its website, Digital Products, and AI tools "as is" and "as available", without any warranties of any kind, express or implied.

We do not warrant that:

• Our website will be uninterrupted, error-free, or free from viruses or harmful components.
• Our Digital Products will meet your specific personal development goals or expectations.
• AI-generated content will be accurate, complete, or suitable for your particular situation.
• Results described or implied in our product descriptions will be achieved by all users.

To the fullest extent permitted by Indian law, MindfulKit LLP, its directors, employees, affiliates, and partners shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or business opportunities.
• Personal, emotional, psychological, financial, or relationship decisions made based on our content or AI tool outputs.
• Losses arising from unauthorised access to or alteration of your data.
• Any matter beyond our reasonable control, including third-party service failures.

In any event, our total liability to you for any claim arising from use of our Services shall not exceed the amount you paid to us for the specific product or service giving rise to the claim, or ₹500, whichever is lower.

Your privacy matters to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

11.1 Data We Collect

We may collect your name, email address, and payment details when you make a purchase. Payment card data is processed directly by our payment partners and is not stored by MindfulKit.

11.2 How We Use It

We use your data to process orders, deliver products, respond to enquiries, and occasionally send product updates or offers (which you may opt out of at any time).

11.3 AI Tool Data

Text entered into AI tools on our website is processed in real time to generate responses and is not stored by MindfulKit on our servers. Third-party AI providers process this data subject to their own privacy policies.

11.4 Your Rights

Under applicable Indian data protection law, you have the right to access, correct, or request deletion of your personal data. To exercise these rights, email support@mindfulkit.in.

Our website may contain links to third-party websites or services, including payment processors, social media platforms, and content partners. These links are provided for convenience only.

MindfulKit has no control over, and accepts no responsibility for, the content, privacy practices, or terms of any third-party website. We encourage you to review the terms and privacy policies of any third-party site you visit.

Our AI tools use Anthropic's Claude API. Anthropic's use of data is governed by Anthropic's own Privacy Policy and Usage Policy.

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising out of or in connection with these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

13.3 Consumer Rights

Nothing in these Terms limits your rights under the Consumer Protection Act, 2019 (India) or other applicable consumer protection legislation. If you have a complaint, we encourage you to first contact us directly at support@mindfulkit.in so we can resolve it amicably.

13.4 Dispute Resolution

In the event of any dispute, both parties agree to first attempt resolution through good-faith negotiation for a period of 30 days before initiating formal legal proceedings.
